By using our website and / or placing an order, you agree to be bound by these terms and conditions.

1. Ordering From Us (top)
You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to correct any errors. Our acceptance of an order takes place when we dispatch the order. When we dispatch the order the purchase contract will be made.

We may refuse to accept an order when the goods are not available, when we cannot obtain authorisation for your payment or if there has been a pricing error. You may pay through PayPal.

Once an order is placed, we will automatically send you an email to confirm it, as well as adding you to our mailing list.

2. Pricing (top)
All prices are in sterling and include VAT (where applicable) at the current rates.

3. Delivery Charges/Rates (top)
Delivery to Mainland UK
Standard Delivery (normally within 2 - 5 working days) is £3.49 within mainland UK on all orders less than £50

UK Standard deliveries are shipped with Royal Mail and should arrive 2 – 5 days after the order is placed. Unfortunately, we are unable to guarantee the efficiency of Royal Mail standard service, although it is generally very good.

Once your order has been dispatched you will receive email notification.  All deliveries will need a signature. If you are not in when your parcel arrives you will be left a card. It is important that you contact the number on this card to rearrange delivery otherwise your bear will be returned to us after a week and you can imagine how he will feel about that!

If this happens we can send him out again but you will have to pay for his transport costs.

If the unthinkable happens and your bear does not arrive please let us know. Please do not wait for weeks until you tell us because we assume they are safe in their new homes if we don't hear from you.

We aim to dispatch all orders received and paid for within 24 hours, subject to the goods being in stock. Please note however that we are a small company and there are only a few of us working here so there may be occasions when this will not be possible.  Please note that orders placed between Friday PM and the following Monday AM will be delivered on the next working day which is Tuesday. Bank holidays and the period between Christmas and New Year are not classed as working days. 

Your delivery charges will be confirmed prior to making payment and so you then have the option to accept the charge prior to confirming your order.

International Deliveries and Deliveries Outside Mainland UK
We are happy to deliver outside mainland  UK. Obviously, the charges will be dependent upon the area / country concerned. We will do our best to obtain a speedy delivery charge and to notify you by email as soon as possible.

Tax and Duty Fees
Your country may charge additional taxes and duties on your order when it enters your country. You are responsible for paying any additional charges.

If delivery cannot be made for any reason, or due to incorrect information being provided, we reserve the right to charge £14.00 if the product is returned to us.

Availablity
In the event that an item is unavailable when you order we will inform you as soon as possible. An alternative or full refund will be offered if money has already been paid.

Failed Deliveries
Our delivery company will deliver between 9am and 5pm Monday to Friday. It is your responsibility to be available when they deliver. If you are not available they will leave a calling card for your to arrange re-delivery or collection. We are not responsible for any delays caused by our courier company that are beyond our control. We are not liable for any losses incurred due to late delivery.

If an incorrect or incomplete delivery address is specified, resulting in failed delivery, redelivery can be arranged (subject to a redelivery cost) or a refund can be issued less delivery costs.

4. Shortages or Damage (top)
Any shortages or damage must be reported by email within three days of delivery of any items.

5. Cancellation and Returns (top)
Cancellation
You may cancel your order at any time before it has been dispatched and will be given a refund less a 10% admin fee to cover card charges. If personalised options have already been done these will not be refunded.

Returns
If for any reason you are not satisfied with your purchase you may return it within 7 days. It must be in its original condition and packaging. A full refund will be applied to the credit card used for the purchase less the postage paid and packaging. If you have had your order sent FREE delivery then the actual delivery charge will be deducted from the refund. The cost of returning the goods to us shall be borne by you. The rights to a refund or to the return of the goods to us will not apply if the goods have been damaged in any way of they are not in their original state. This does not affect your statutory rights.

Proof of posting is not proof of receipt by us. We recommend you use Royal Mail Recorded or Special Delivery.

Where goods are faulty postage costs will be refunded.

Faulty items must be reported to us within 3 days of delivery. We will then issue a returns reference and arrange a refund or replacement as appropriate for that particular item.

6. Disclaimer (top)
Whist we endeavour to ensure that the information on this Website is correct, we do not warrant the accurate and completeness of the material of this Website.

7. Governing Law and Jurisdiction (top)
These terms and conditions shall be governed by and construed in accordance with English Law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

8. Privacy Policy (top)
Fudgy Bear Books respect your right to privacy. None of the information we collect is passed on to other parties, except when required as part of the business services we provide for you, or as required under UK law. We may use your email address to contact you about new products and future offers but you may unsubscribe from these emails and we will not contact you again.

9. Remittance Terms (top)
All items must be paid for in full before any orders are dispatched. Payment can be made via PayPal.
